Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Flash Card Alarm mobile application ("App") operated by Flash Card Alarm ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the App.

2. Description of Service

Flash Card Alarm is a vocabulary learning application that combines flashcard quizzes with alarm functionality. The App provides:

  • Alarm-based quizzes: Set alarms that require solving vocabulary quizzes to dismiss.
  • AI Smart Scan: Extract vocabulary words from images using AI-powered text recognition.
  • Vocabulary management: Create, organize, and study word groups with spaced repetition.
  • Study statistics: Track quiz performance, streaks, and mastery progress.
  • Text-to-Speech: Hear word pronunciations using your device's built-in TTS.

3. Eligibility

  • You must be at least 13 years old to use the App. If you are under 18, you must have the consent of a parent or legal guardian.
  • If you are located in the European Economic Area (EEA), you must be at least 16 years old to use the App, or have verifiable parental consent.
  • By using the App, you represent and warrant that you meet these age requirements.

4. Account Registration

  • You must create an account using Google Sign-In or Sign in with Apple to use the App.
  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate information and keep it up to date.
  • You may not create accounts for the purpose of abusing the App's features (such as free-tier limits).
  • We reserve the right to suspend or terminate accounts that violate these Terms.

5. Free and Premium Plans

5.1 Free Tier

The free tier includes:

  • Up to 3 word groups
  • Up to 100 words total
  • 3 AI Smart Scans per day
  • Advertisements (banner, interstitial, and rewarded ads)

Additional slots may be earned by watching rewarded video ads.

5.2 Premium Plan

The premium subscription removes advertisements and expands usage limits. Premium features include:

  • Unlimited word groups and words
  • 10 AI Smart Scans per day (with additional scans available via rewarded ads)
  • No advertisements
  • Access to advanced study statistics and reports

5.3 Subscriptions

  • Premium subscriptions are billed monthly or annually through the Apple App Store or Google Play Store.
  • Payment will be charged to your Apple ID account (or Google Play account) at confirmation of purchase.
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same price as your initial subscription.
  • You can manage and cancel your subscription by going to your device's Settings → [Your Name] → Subscriptions (iOS) or Google Play → Subscriptions (Android).
  • No cancellation of the current subscription is allowed during the active subscription period. If you cancel, your subscription benefits will remain active until the end of the current billing period.
  • Refunds are subject to the policies of the Apple App Store or Google Play Store.
  • Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
  • Promotional codes may be redeemed for temporary premium access as specified at the time of issuance.

6. User Content

6.1 Ownership

You retain ownership of all vocabulary data, word groups, and other content you create within the App ("User Content").

6.2 License

By using the App, you grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing the App's services to you.

6.3 Prohibited Content

You agree not to use the App to create, store, or distribute content that:

  • Is illegal, harmful, threatening, abusive, or harassing.
  • Infringes on any intellectual property rights.
  • Contains malware or malicious code.
  • Violates any applicable laws or regulations.

7. AI Smart Scan

  • The AI Smart Scan feature uses Google's Gemini AI to extract vocabulary from images you provide.
  • Images are processed in real time and are not permanently stored by us.
  • AI-generated definitions, examples, and categorizations are provided for educational purposes and may not always be accurate. You should verify AI-generated content.
  • We are not responsible for errors or inaccuracies in AI-generated content.

8. Advertisements

  • Free-tier users will see advertisements provided by Google AdMob.
  • Ad content is controlled by Google and its advertising partners, not by us.
  • We are not responsible for the content of third-party advertisements.

9. Intellectual Property

  • The App, including its design, code, features, logos, and content (excluding User Content), is owned by us and protected by applicable intellectual property laws.
  • You may not copy, modify, distribute, sell, or reverse-engineer any part of the App.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, error-free, or secure.
  • The results obtained from the App (including AI-generated content) will be accurate or reliable.
  • Any defects will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

Our total liability for any claim arising from these Terms or the App shall not exceed the amount you paid us in the 12 months preceding the claim, or $10.00, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold us harmless from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with:

  • Your use of the App.
  • Your violation of these Terms.
  • Your User Content.

13. Account Termination

  • You may delete your account at any time through the App's Settings.
  • We may suspend or terminate your account if you violate these Terms.
  • Upon termination, your right to use the App ceases immediately. Your data may be retained for up to 30 days as described in our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App. Your continued use of the App after changes take effect constitutes acceptance of the new Terms.

15. Dispute Resolution

15.1 Informal Resolution

Before filing any legal claim, you agree to first contact us at the email address provided in Section 20 and attempt to resolve the dispute informally for at least 30 days.

15.2 Binding Arbitration

If a dispute cannot be resolved informally, you and we agree to resolve any claims relating to these Terms or the App through final and binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, except as set forth below. The arbitration will be conducted in Los Angeles County, California, unless you and we agree otherwise.

15.3 Class Action Waiver

YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of a representative or class proceeding.

15.4 Exceptions

Either party may bring claims in small claims court if the claim qualifies. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Apple Licensed Application End User License Agreement

If you access or download the App from the Apple App Store, you acknowledge and agree that:

  • These Terms are between you and Flash Card Alarm only, and not with Apple Inc. ("Apple").
  • Apple has no obligation to furnish any maintenance or support services with respect to the App.
  • Apple is not responsible for addressing any claims relating to the App, including but not limited to product liability claims, consumer protection claims, or intellectual property infringement claims.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
  • Usage of the App is also subject to the terms of the Apple Licensed Application End User License Agreement.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter herein.
